Who I am
CapyWatcher is made and run by one person, a sole proprietor in Poland whose name, address and tax number are in the legal notice. I go by Admiral Capy. In these terms, “I”, “me” and “my” mean that sole proprietor, and “you” means the person who uses the app or the website.
Agreeing to these terms
By installing the app, using it, buying a license for it or using this website, you agree to these terms. If you don’t agree, don’t install or use the app and don’t use the website. These terms are free to read before you install the app or buy a license, and you can save or print this page at any time.
If you’re a consumer, nothing in these terms takes away the rights the law of your country gives you. Where these terms say “consumer”, they also mean a sole trader whose purchase isn’t part of their profession.
What I provide
- The app. CapyWatcher is a Windows app. It records which program created each new file in the folders you choose, and shows it when you right-click the file. Its history stays on your computer.
- The license service. The app’s license check and update check, answered by my server at
api.capywatcher.com. They are part of the app and need no account. - The website.
capywatcher.com, with information about the app, its prices, the release notes and their RSS feed.
The website and the free trial are free. A license is paid, and Creem sells it, as described below.
What you need
- For the app: a computer with Windows 11, 64-bit (x64). Other Windows versions aren’t tested.
- For the license check and the update check: an internet connection. A licensed computer needs to reach the server at least once every 30 days. Between checks the app works offline.
- For the website: a current web browser. JavaScript is only needed to show the details in the legal notice and to switch between the light and dark theme.
Your license to use the app
CapyWatcher is closed source. I grant you a license to use it, which you can’t transfer to anyone else. You don’t buy the software itself.
- During the free trial, you may use the app on the computer where the trial runs. While your license is active, you may use it on up to 3 computers at a time, for personal or business use. A computer is a physical computer or a virtual machine.
- You may not sell, rent, lend or give away the app or your license key.
- You may not reverse engineer, decompile or disassemble the app, except as far as the law allows it.
- You may not remove, disable or get around the app’s license checks.
- The open source parts the app is built with stay under their own licenses.
The free trial
The free trial is 7 days of full use, with no email and no account. It starts the first time you open the app on a computer. When it ends, the app keeps recording new files, and shows which program created them again once you enter a license key.
Buying a license
- Creem is the Merchant of Record: Armitage Labs OÜ, Rotermanni 14, 10111 Tallinn, Estonia. Creem sells the license to you as a reseller, takes the payment, adds tax where it applies and is the seller on your invoice. Creem’s buyer terms (opens in a new tab) apply to the purchase and the payment.
- The yearly plan costs $29 a year, before tax, and renews each year until you cancel. You can cancel at any time in Creem’s customer portal. The license then stays active to the end of the year you paid for.
- The lifetime license costs $49 once, before tax, and covers every future release.
- Each license covers up to 3 computers at a time. You can remove a computer from the license in the app to make room for another.
- Your license key is delivered right after payment, on Creem’s receipt and in Creem’s customer portal. Enter it in the app to activate the license.
Renewals and the grace period
The app reminds you 14 days before a yearly plan renews. If a yearly plan isn’t renewed, the app keeps working for 14 days after the end of the year you paid for. After those 14 days it keeps recording new files, and shows which program created them again once you renew or buy a lifetime license.
Refunds
You get a full refund within 14 days of a purchase or a renewal, for any reason. This is my own promise, on top of your rights under the law. The refund policy has the details.
License checks and shared keys
The app checks its license with my server, as described in the privacy policy. A license key belongs to the person who bought it. If a key looks shared or leaked, for example when it’s activated on many more computers than a license covers:
- the app first shows a warning on the computers that use the key,
- then asks the owner to sort it out,
- and I may then block the key if it’s still shared, sold or published in breach of these terms.
If you think a key was blocked by mistake, write to me and I’ll look at it. A refund or a chargeback ends the key it paid for.
Using the website and support
You may use the website and write to support for any lawful purpose. You agree not to:
- send unlawful content, in a support message or anywhere else,
- try to disrupt, overload or get unauthorized access to the website, the license server or their systems,
- copy the website’s text or design to republish it, mirror it or run a copy of it elsewhere.
Search engines may index the website as its robots.txt allows.
No warranty
The app and the website are provided as they are. As far as the law allows, I give no warranty that the app meets your needs, works without errors or records every file. The app records only new files, in the folders you choose, on the drives in your computer, from the moment it’s installed.
If you’re a consumer, the rights the law gives you when digital content isn’t as agreed stay as they are.
Liability
If you’re a consumer, I’m liable as the law provides, and nothing in these terms limits it.
If you use the app for your business, my liability for any claim about the app, the website or a license is limited, as far as the law allows, to the price you paid for that license in the 12 months before the claim. I’m not liable for lost profits, lost data or indirect damage. These limits don’t apply to damage caused on purpose or by gross negligence, or to harm to life or health.
Intellectual property
The CapyWatcher name, the logo, the capybara character, the app, and the website’s text and design are mine. These terms give you the right to use the app as described above. You may not copy, publish or redistribute any of them without my written permission, except where the law allows it, for example a short quote with its source.
Ending the agreement
- You can stop at any time: uninstall the app, and cancel a yearly plan in Creem’s customer portal. Your history stays on your computer until you delete it.
- I may end your license only for a serious breach of these terms, such as selling, sharing or publishing your key, or getting around the license checks. Before I do, I’ll ask you to stop through the app, unless the breach is clear and continuing.
- If I ever stop running the license server, I’ll announce it at least 90 days ahead and, before it stops, publish a final version of the app that works without the license check, for everyone with a paid license.
Complaints
If something about the app, the website or a license isn’t as it should be, write to me by email or on X (see Contact below). Say what happened, on which computer or page, and what you’d like me to do. I answer every complaint within 14 days of receiving it.
Complaints about a payment can also go to Creem, as its buyer terms describe. If you’re a consumer in Poland, you can also ask your local consumer ombudsman (rzecznik konsumentów) or the Trade Inspection (Inspekcja Handlowa) for help. Consumers elsewhere in the EU can turn to their national consumer bodies.
Changes to these terms
If these terms change, the new version is posted on this page with its date. A change applies to new installs and new purchases. A license you already have keeps the terms in force when you bought it, unless a change is needed because the law changes or to fix a security problem, and no change takes away what you paid for.
Law and courts
These terms are governed by Polish law. If you’re a consumer living in another country, you also keep the protection of the rules of that country’s law that can’t be set aside by agreement, and you may take a dispute to the courts where you live. A dispute with a business user goes to the court for my place of business.
